Local Government Litigation
When hiring an attorney it is important for a client to know that the lawyer has experience in the specific field. Mark served as a Senior Assistant City Attorney for the City of Miami Beach from 1997-1999 defending the City and it police officers against many types of civil rights and state law claims. From 2000-2003 Mark served as the City Attorney of Hallandale Beach supervising the City’s legal department and managing all of the City’s litigation, including defending slip and fall cases, automobile accident lawsuit and accidents that occurred in the City’s parks and facilities. While in private practice Mark has been retained by the Florida Department of Financial Services to defend the Florida Department of Transportation in negligence cases. Mark also served as Deputy City Attorney for the City of South Miami and handled that City’s litigation.
All of the above experience has well equipped Mark to represent private property owners and other claimants against local governments. Mark has successfully sued local governments for clients in Federal Court to challenge ordinances which required annual inspections of rental units as a condition of occupancy by a new tenant. Mark has also successfully challenged a city granting a property owner a variance to place a prohibited use next to a client’s business. On another occasion he has successfully challenged on First Amendment grounds a city’s legislation which prohibited a City Commissioner from speaking on an issue at a meeting of another public entity. Mark regularly serves as outside counsel to public officials who are sued for actions taken in their capacity as City Commissioners.
